The Platform may be provided or be accessible via multiple websites or applications whether owned and/or operated by us or by third parties, including, without limitation, the website betterheal.us and its related apps.

By accessing or using the Platform, you are entering into this Agreement. You should read this Agreement carefully before starting to use the Platform. If you do not agree to be bound by any term of this Agreement, you must not access the Platform.

When the terms "we", "us", "our" or similar are used in this Agreement, they refer to any company that owns and operates the Platform (the "Company").

2. The Therapists and Therapist Services

The Platform may be used to connect you with a provider, variously credentialed and experienced based on the applicable jurisdiction ("Therapist") who will provide services to you through the Platform ("Therapist Services").

For U.S. based Therapists

We require every Therapist providing Therapist Services on the Platform to be an accredited, trained, and experienced licensed U.S. psychologist (PhD / PsyD), licensed marriage and family therapist (LMFT), licensed clinical social worker (LCSW), licensed professional counselor (LPC), or similar applicable recognized professional certification based on their state and/or jurisdiction. Therapists must have a relevant academic degree in their field, at least 3 years of experience, at least 1,000 hours of hands-on experience, and be qualified and certified by their respective professional board after successfully completing the necessary education, exams, training and practice requirements as applicable.

3. Platform Services

BetterHeal provides a platform that connects users with licensed mental health professionals. Our services include but are not limited to:

• Matching users with appropriate therapists based on preferences and needs
• Facilitating secure communication between users and therapists
• Providing tools for scheduling and managing therapy sessions
• Offering educational resources and wellness tools
• Processing payments for therapy services

4. User Responsibilities

By using our Platform, you agree to:

• Provide accurate and complete information during registration
• Maintain the confidentiality of your account credentials
• Use the Platform only for lawful purposes
• Respect the professional boundaries established by your therapist
• Pay all fees associated with your use of the Platform
• Comply with all applicable laws and regulations

5. Privacy and Confidentiality

We take your privacy seriously and are committed to protecting your personal information. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and protect your information. All communications between you and your therapist are confidential and protected by applicable privacy laws.

6. Payment Terms

Payment for services is due in advance of receiving therapy services. We accept various payment methods as indicated on our Platform. All fees are non-refundable except as specifically provided in our refund policy. You are responsible for all charges incurred under your account.

7. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures.

CLASS ACTION WAIVER: You agree that any arbitration shall be limited to the dispute between us and you individually. You acknowledge and agree that you and BetterHeal are each waiving the right to a trial by jury or to participate in a class action.

8. Limitation of Liability

To the fullest extent permitted by law, BetterHeal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

9. Termination

Either party may terminate this Agreement at any time. Upon termination, your right to use the Platform will cease immediately. Provisions that by their nature should survive termination shall survive, including but not limited to warranty disclaimers, indemnity, and limitations of liability.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
